O \u00f3rg\u00e3o j\u00e1 existia e, agora, passa a ter oficialmente a atribui\u00e7\u00e3o de \u201cfixar a interpreta\u00e7\u00e3o da Constitui\u00e7\u00e3o\u201d.<br>Ele tem objetivo de prestar assessoria e consultoria jur\u00eddica ao\u00a0<a href=\"https:\/\/www.gov.br\/defesa\/pt-br\" target=\"_blank\" rel=\"noreferrer noopener\">Minist\u00e9rio da Defesa<\/a>\u00a0e aos comandantes da Marinha, do Ex\u00e9rcito e da Aeron\u00e1utica.<br>O artigo 1\u00ba do regimento interno estabelece que o \u00f3rg\u00e3o deve \u201cfixar a interpreta\u00e7\u00e3o da Constitui\u00e7\u00e3o, das leis, dos tratados e dos demais atos normativos, a ser uniformemente seguida na \u00e1rea de atua\u00e7\u00e3o do Minist\u00e9rio quando n\u00e3o houver orienta\u00e7\u00e3o normativa do Advogado-Geral da Uni\u00e3o\u201d.<br><br>A consultoria jur\u00eddica \u00e9 composta por integrantes da Advocacia-Geral da Uni\u00e3o e subordinada administrativamente ao ministro da Defesa. Atualmente a pasta \u00e9 comandada pelo general\u00a0<a href=\"https:\/\/www.gov.br\/defesa\/pt-br\/composicao\/gabinete-do-ministro\/paulo-sergio-nogueira-de-oliveira\" target=\"_blank\" rel=\"noreferrer noopener\">Paulo S\u00e9rgio Nogueira<\/a>.<br><br>Esse tipo de assessoria jur\u00eddica j\u00e1 existe, com a mesma finalidade, em outras pastas, como no Minist\u00e9rio da Cidadania e na Educa\u00e7\u00e3o.<br><br>Chama a aten\u00e7\u00e3o, contudo, o timing da aprova\u00e7\u00e3o do regimento interno do \u00f3rg\u00e3o junto ao Minist\u00e9rio da Defesa. O corpo jur\u00eddico passa a exercer oficialmente a fun\u00e7\u00e3o de interpretar a Constitui\u00e7\u00e3o no momento em que Bolsonaro estuda acionar as For\u00e7as Armadas para tentar anular o resultado das elei\u00e7\u00f5es.<br>Aliados do presidente veem a publica\u00e7\u00e3o no Di\u00e1rio Oficial como tentativa de respaldo legal caso invoque o artigo 142.<br>J\u00e1 Associa\u00e7\u00e3o Nacional dos Advogados da Uni\u00e3o (Anauni) afirma que: \u201cnos termos do art. 11, III, da Lei Complementar n\u00ba 73\/93, n\u00e3o houve qualquer inova\u00e7\u00e3o no novo normativo editado. Sendo assim, a interpreta\u00e7\u00e3o da Constitui\u00e7\u00e3o, das leis, dos tratados e dos demais atos normativos \u00e9 tarefa regular de qualquer Consultoria Jur\u00eddica vinculado a quaisquer Minist\u00e9rios, n\u00e3o sendo um dever diferenciado o que foi previsto na norma propagada.\u201d<br>A\u00a0<a href=\"https:\/\/www.in.gov.br\/en\/web\/dou\/-\/portaria-normativa-agu-n-74-de-16-de-dezembro-de-2022-452048783\" target=\"_blank\" rel=\"noreferrer noopener\">portaria normativa<\/a>\u00a0\u00e9 assinada por\u00a0<a href=\"https:\/\/www.metropoles.com\/brasil\/saiba-quem-e-bruno-bianco-o-novo-advogado-geral-da-uniao?amp\" target=\"_blank\" rel=\"noreferrer noopener\">Bruno Bianco<\/a>, chefe da Advogacia-Geral da Uni\u00e3o, \u00f3rg\u00e3o subordinado \u00e0 Presid\u00eancia da Rep\u00fablica.<br>Nos \u00faltimos dias,\u00a0<a href=\"https:\/\/www.metropoles.com\/colunas\/paulo-cappelli\/valdemar-resiste-a-contestar-diploma-de-lula-bolsonaro-cogita-plano-b?amp\" target=\"_blank\" rel=\"noreferrer noopener\">Bolsonaro voltou a cogitar<\/a>\u00a0recorrer \u00e0s For\u00e7as Armadas para uma ruptura institucional. A medida retornou ao radar ap\u00f3s Valdemar da Costa Neto, presidente do PL, negar-se a\u00a0<a href=\"https:\/\/www.metropoles.com\/colunas\/paulo-cappelli\/valdemar-e-bolsonaro-da-gratidao-ao-limite?amp\" target=\"_blank\" rel=\"noreferrer noopener\">contestar judicialmente a
