A medida foi tomada ap\u00f3s o aplicativo n\u00e3o bloquear a conta do deputado federal eleito Nikolas Ferreira (PL-MG). <br \/>Moraes disse que a empresa n\u00e3o pode deixar de cumprir decis\u00f5es judiciais em territ\u00f3rio brasileiro, sendo considerado uma derrota para o ministro Alexandre de Moraes.<br \/>\u201cComo qualquer entidade privada que exer\u00e7a sua atividade econ\u00f4mica no territ\u00f3rio nacional, a rede social Telegram deve respeitar e cumprir, de forma efetiva, comandos diretos emitidos pelo Poder Judici\u00e1rio relativos a fatos ocorridos ou com seus efeitos perenes dentro do territ\u00f3rio nacional; cabendo-lhe, se entender necess\u00e1rio, demonstrar seu inconformismo mediante os recursos permitidos pela legisla\u00e7\u00e3o brasileira\u201d, afirmou. <br \/>Na decis\u00e3o, o ministro disse que o bloqueio da conta do parlamentar n\u00e3o \u00e9 censura e est\u00e1 autorizada pela legisla\u00e7\u00e3o nos casos de desvirtuamento do livre exerc\u00edcio da liberdade de express\u00e3o. <br \/>\u201cOs bloqueios das contas de redes sociais determinados nestes autos se fundam na necessidade de fazer cessar a continuidade da divulga\u00e7\u00e3o de manifesta\u00e7\u00f5es criminosas, que, em concreto, materializam as infra\u00e7\u00f5es penais apuradas neste inqu\u00e9rito e, que continuam a ter seus efeitos il\u00edcitos dentro do territ\u00f3rio nacional, inclusive pela utiliza\u00e7\u00e3o de subterf\u00fagios permitidos pela rede social Telegram\u201d, concluiu. <br \/>Em of\u00edcio enviado ao ministros antes da decis\u00e3o, o Telegram pediu a reconsidera\u00e7\u00e3o do bloqueio do perfil de Nikolas e alegou falta de fundamenta\u00e7\u00e3o.
