TSE cassa prefeito de Brusque e torna Luciano Hang ineleg\u00edvel

Nesta quinta-feira (4), o plen\u00e1rio do Tribunal Superior Eleitoral (TSE) decidiu, por 5 a 2 votos, cassar o mandato do prefeito de Brusque, Ari Vequi (MDB), por abuso de poder econ\u00f4mico na campanha eleitoral de 2020.
A decis\u00e3o se deu em raz\u00e3o da utiliza\u00e7\u00e3o da estrutura da varejista Havan, maior empresa da cidade, em favor dele, em sucessivos v\u00eddeos publicados pelo empres\u00e1rio Luciano Hang, nas redes sociais.
Pela decis\u00e3o, Hang fica ineleg\u00edvel at\u00e9 2028. O prazo equivale aos oito anos previstos na Lei da Ficha Limpa, mas contados a partir das elei\u00e7\u00f5es municipais de 2020. O empres\u00e1rio \u00e9 acusado de ter praticado o abuso de poder econ\u00f4mico.
Com a decis\u00e3o, o TSE reverte julgamento do Tribunal Regional Eleitoral de Santa Catarina (TRE-SC), que n\u00e3o havia visto abuso de poder econ\u00f4mico na campanha promovida por Hang em favor de Vequi. A corte regional considerou que a sequ\u00eancia de v\u00eddeos publicados pelo empres\u00e1rio seria uma mera opini\u00e3o pol\u00edtica protegida pela liberdade de express\u00e3o.
A a\u00e7\u00e3o original havia sido aberta por Podemos, PT, PSB e Partido Verde, que recorreram ao TSE. O relator do caso, ministro Ricardo Lewandowski, considerou que n\u00e3o seria poss\u00edvel reverter a decis\u00e3o do TRE-SC, pois para isso seria necess\u00e1rio reexaminar as provas, o que n\u00e3o seria permitido pela jurisprud\u00eancia.
Contudo, segundo a votar, o presidente do TSE, ministro Alexandre de Moraes, decidiu n\u00e3o considerar essa quest\u00e3o processual, diante do que considerou provas robustas do abuso de poder econ\u00f4mico. Ele apontou a reiterada utiliza\u00e7\u00e3o da logomarca e de ativos da Havan \u2013 entre os quais caminh\u00f5es, lojas e recursos humanos \u2013 para fazer \u201ccampanha paralela\u201d, sem presta\u00e7\u00e3o de contas, em favor de Vequi e contra os demais candidatos.
Moraes destacou o que considerou serem exemplos mais graves dessa atua\u00e7\u00e3o indevida. Num dos v\u00eddeos publicados nas redes sociais, com cerca de 180 mil visualiza\u00e7\u00f5es, Hang veste camisa da Havan e promove uma esp\u00e9cie de evento pol\u00edtico com funcion\u00e1rios numa de suas lojas, em 14 de novembro de 2022, v\u00e9spera do pleito municipal.
\u2013 Nesse contexto, imp\u00f5e-se ao Tribunal Superior Eleitoral, a partir da sucess\u00e3o de fatos narrados, aferir a legitimidade da atua\u00e7\u00e3o de Luciano Hang no \u00e2mbito da disputa eleitoral ou se os comportamentos praticados, por meio da indevida vincula\u00e7\u00e3o da pessoa jur\u00eddica Lojas Havan com a campanha, representaram quebra da isonomia do pleito em benef\u00edcio dos candidatos Recorridos [Ari Vequi e seu vice, Gilmar Doerner], decorrente de abuso do poder econ\u00f4mico \u2013 disse Moraes.
Seguiram o entendimento do presidente do TSE os ministros C\u00e1rmen L\u00facia, Benedito Gon\u00e7alves, Sergio Banhos e Carlos Horbach. Ficaram vencidos o relator, Lewandowski, e o ministro Raul Ara\u00fajo.
Pela decis\u00e3o, a cassa\u00e7\u00e3o dos diplomas do prefeito Ari Vequi (MDB) e Gilmar Doerner (Republicanos) deve ser comunicada ao TRE-SC e ter efeitos imediatos, sem que seja necess\u00e1rio aguardar a publica\u00e7\u00e3o do ac\u00f3rd\u00e3o (decis\u00e3o colegiada) do TSE.
