Essa lei prev\u00ea que em caso de n\u00e3o pagamento a institui\u00e7\u00e3o credora pode realizar uma execu\u00e7\u00e3o extrajudicial e retomar o im\u00f3vel. O procedimento \u00e9 feito por meio de um cart\u00f3rio e n\u00e3o passa pela Justi\u00e7a. <br>O relator, ministro Luiz Fux, considerou a lei constitucional e foi seguido pelos ministros Cristiano Zanin, Andr\u00e9 Mendon\u00e7a, Alexandre de Moraes e Dias Toffoli. O julgamento foi suspenso e ser\u00e1 retomado na quinta-feira com o voto de Edson Fachin, que indiciou que ir\u00e1 divergir do relator. <br>Em seu voto, Fux concordou com os argumentos de que o modelo atual contribuiu para a redu\u00e7\u00e3o dos custos do setor: <br>\u2014 A exig\u00eancia de judicializa\u00e7\u00e3o da execu\u00e7\u00e3o dos contratos de m\u00fatuos com aliena\u00e7\u00e3o fiduci\u00e1ria de im\u00f3veis iria de encontro aos avan\u00e7os e aprimoramentos no arcabou\u00e7o legal do mercado de cr\u00e9dito imobili\u00e1rio, os quais tiveram significativa contribui\u00e7\u00e3o para o crescimento do setor e redu\u00e7\u00e3o dos riscos e custos \u2014 avaliou o relator. <br>No caso que motivou o julgamento, um homem questionou a aliena\u00e7\u00e3o de seu im\u00f3vel realizada pela Caixa Econ\u00f4mica Federal, alegando que n\u00e3o houve direito \u00e0 ampla defesa, ao contradit\u00f3rio. <br>A senten\u00e7a foi mantida pelo Tribunal Regional Federal da 3\u00aa Regi\u00e3o (TRF-3), e houve recurso para o STF. A decis\u00e3o ter\u00e1 repercuss\u00e3o geral, ou seja, ter\u00e1 que ser seguida nos demais casos semelhantes em todo o pa\u00eds. <br>A procuradora-geral da Rep\u00fablica interina, Elizeta Ramos, defendeu que o recurso seja aceito, por considerar que o modelo atual n\u00e3o respeita o devido processo legal. <br>\u2014 Uma vez que as bases de garantia do processo judicial \u00e9 a exist\u00eancia de juiz imparcial, alheio \u00e0 lide, que fa\u00e7a valer os direitos materiais e instrumentais das partes, parece correto concluir que o desaparecimento dessa figura compromete o devido processo legal. <br>Falando em nome da Caixa, o advogado Carlos Augusto Genier argumentou que o modelo atual permite taxas mais baixas de juro. <br>\u2014 A sistem\u00e1tica em que oferece maiores condi\u00e7\u00f5es de recuperabilidade de cr\u00e9dito, contribui diretamente \u00e0 manuten\u00e7\u00e3o das baixas taxas do mercado. Ao tornar mais caro o cr\u00e9dito imobili\u00e1rio, quem se prejudica \u00e9 aquele que efetivamente cumpre suas obriga\u00e7\u00f5es. <br>Institui\u00e7\u00f5es como o Banco Central do Brasil (BC), a Federa\u00e7\u00e3o Brasileira de Bancos (Febraban) e a Defensoria P\u00fablica da Uni\u00e3o (DPU) participaram do julgamento como<em>&#8220;amicus curiae&#8221;<\/em>e apresentaram argumentos no julgamento. <br>O advogado Gustavo C\u00e9sar Mour\u00e3o, que falou em nome da Febraban, afirmou que o sistema provocou uma &#8220;revolu\u00e7\u00e3o&#8221; no mercado de cr\u00e9dito imobili\u00e1rio e ressaltou que somente em 5% dos casos de inadimpl\u00eancia a execu\u00e7\u00e3o extrajudicial \u00e9 necess\u00e1ria. <br>\u2014 Nos outros 95% dos processos que s\u00e3o iniciados, h\u00e1 de fato a solu\u00e7\u00e3o da inadimpl\u00eancia pela purga\u00e7\u00e3o da mora e pela definitiva aquisi\u00e7\u00e3o de im\u00f3vel pelo tomador \u2014 destacou. <br>J\u00e1 o defensor p\u00fablico federal Gustavo Zort\u00e9a da Silva considerou que h\u00e1 uma viola\u00e7\u00e3o do contradit\u00f3rio. <br>\u2014 Quero primeiro mencionar a viola\u00e7\u00e3o ao contradit\u00f3rio, \u00e0 ampla defesa e ao devido processo legal. No procedimento da lei n\u00e3o h\u00e1 espa\u00e7o para apresentar raz\u00f5es que possam questionar os valores exigidos pelo credor ou para descaracterizar a mora.<br>O Globo
