O Senado Federal volta a discutir nesta ter\u00e7a-feira, 31, a Proposta de Emenda \u00e0 Constitui\u00e7\u00e3o (PEC) que limita as decis\u00f5es monocr\u00e1ticas do Supremo Tribunal Federal (STF) e cria regras para os pedidos de vista.

A PEC 8\/2021<\/a><\/strong>, aprovada na Comiss\u00e3o de Constitui\u00e7\u00e3o e Justi\u00e7a do Senado em 4 de outubro<\/a><\/strong>, come\u00e7ou a ser discutida no plen\u00e1rio h\u00e1 uma semana. Antes disso, em 19 de outubro, o tema foi alvo de uma audi\u00eancia p\u00fablica organizada pelo presidente da Casa, Rodrigo Pacheco (PSD-MG).
\u201cSabemos tamb\u00e9m que os Tr\u00eas Poderes do Brasil s\u00e3o independentes e harm\u00f4nicos. E podem sempre evoluir, seja por iniciativa pr\u00f3pria, seja com a contribui\u00e7\u00e3o de um outro Poder\u201d, afirmou Pacheco, em debate no plen\u00e1rio.

O relator da PEC \u00e9 Esperidi\u00e3o Amin (PP-SC). \u201cEu n\u00e3o tenho d\u00favida que todos concordam que n\u00e3o pode se ficar como est\u00e1. E muito menos nos ocorrer a ideia de recuar para evitar atritos\u201d, disse Amin.
A previs\u00e3o \u00e9 de que a PEC, que tem apoio da oposi\u00e7\u00e3o, seja votada no dia 8 de novembro, prazo necess\u00e1rio para decorrerem as cinco sess\u00f5es regimentalmente exigidas.
A rea\u00e7\u00e3o do Senado para limitar os poderes do STF veio depois que a Corte pautou e come\u00e7ou a julgar a legaliza\u00e7\u00e3o do aborto. A ministra Rosa Weber, agora aposentada, chegou a apresentar um voto favor\u00e1vel \u00e0 descriminaliza\u00e7\u00e3o da pr\u00e1tica a pedido do Psol. O julgamento foi suspenso em raz\u00e3o do um pedido de destaque do agora presidente da Corte, Lu\u00eds Roberto Barroso.
O que prev\u00ea a PEC para limitar os poderes do STF

A PEC acrescenta dispositivo na Constitui\u00e7\u00e3o para proibir decis\u00f5es monocr\u00e1ticas \u2014 dadas por um ministro \u2014 para suspender a efic\u00e1cia de leis com efeito geral e de ato dos presidentes da Rep\u00fablica, do Senado, da C\u00e2mara dos Deputados ou do Congresso Nacional. Esses casos somente poderiam ser decididos no plen\u00e1rio, com o voto da maioria, ou seja, de pelo menos seis ministros.
Hoje, com a decis\u00e3o de um \u00fanico ministro, uma lei perde a validade imediatamente. Um caso recente \u00e9 o da Lei das Estatais, at\u00e9 hoje suspensa por uma liminar do ministro aposentado Ricardo Lewandowski concedida em mar\u00e7o e ainda n\u00e3o referendada pelo plen\u00e1rio do STF. O ex-ministro liberou indica\u00e7\u00f5es pol\u00edticas para cargos de diretoria e de conselhos das empresas p\u00fablicas.

Quanto aos pedidos de vista, a PEC estabelece que o pedido de mais prazo para an\u00e1lise de um processo feito por um ministro deve ser concedido de forma coletiva a todos, por at\u00e9 seis meses. Depois disso, uma \u00fanica nova concess\u00e3o de vista ser\u00e1 dada, por no m\u00e1ximo tr\u00eas meses e tamb\u00e9m de maneira coletiva. Com isso, a inten\u00e7\u00e3o \u00e9 impedir que a\u00e7\u00f5es fiquem engavetadas por longos per\u00edodos, a depender da vontade dos ministros liberarem o
