O ex-prefeito Carlos Eduardo soltou um release para imprensa na tarde desta segunda-feira, publicado no BLOGDOBG que a senten\u00e7a de condena\u00e7\u00e3o dele no superfaturamento do MACHADAO teria sido anulada.<br>Veja o que diz o blog de Dinarte Assun\u00e7\u00e3o:<br>O ex-prefeito de Natal, Carlos Eduardo Alves, divulgou um release afirmando que o Tribunal de Contas da Uni\u00e3o (TCU) teria anulado sua condena\u00e7\u00e3o no processo relacionado \u00e0s obras de reforma do Est\u00e1dio Machad\u00e3o. Segundo o release, a nova determina\u00e7\u00e3o do TCU teria \u201canulado a condena\u00e7\u00e3o anterior\u201d, livrando-o de qualquer responsabilidade.<br>O Blog do Dina chegou a divulgar o release, mas ao checar o fato e constatar que era uma distor\u00e7\u00e3o, retirou a mat\u00e9ria do ar.<br>No release, Carlos Eduardo declarou:<br>\u201cA nova determina\u00e7\u00e3o anula a condena\u00e7\u00e3o anterior de Carlos Eduardo. Agora, estou completamente livre de qualquer condena\u00e7\u00e3o relacionada a esse processo.\u201d<br>&nbsp;<br>No entanto, a decis\u00e3o oficial do TCU, assinada pelo ministro Vital do R\u00eago, mostra que o Tribunal apenas suspendeu temporariamente os efeitos da decis\u00e3o anterior enquanto o recurso de reconsidera\u00e7\u00e3o apresentado por Carlos Eduardo est\u00e1 sendo analisado. O despacho do TCU afirma:<br>\u201cConhe\u00e7o do recurso de reconsidera\u00e7\u00e3o interposto por Carlos Eduardo Nunes Alves [\u2026] suspendendo-se os efeitos dos itens 9.1, 9.2, 9.3, 9.4 e 9.5 do Ac\u00f3rd\u00e3o 1.363\/2024-TCU-Plen\u00e1rio, em rela\u00e7\u00e3o ao recorrente.\u201d<br>A suspens\u00e3o dos efeitos da condena\u00e7\u00e3o n\u00e3o implica em anula\u00e7\u00e3o ou exonera\u00e7\u00e3o definitiva, mas sim em uma medida cautelar durante a an\u00e1lise do recurso. Al\u00e9m disso, o despacho do TCU estende a suspens\u00e3o aos demais respons\u00e1veis condenados juntamente com Carlos Eduardo.<br>&nbsp;<br>Outro ponto mencionado no release \u00e9 a alega\u00e7\u00e3o de que o Minist\u00e9rio P\u00fablico teria sugerido o arquivamento do caso devido \u00e0 prescri\u00e7\u00e3o. Contudo, essa informa\u00e7\u00e3o n\u00e3o consta no despacho do TCU.<br>Dessa forma, o que o TCU determinou foi uma suspens\u00e3o tempor\u00e1ria dos efeitos da condena\u00e7\u00e3o anterior, e n\u00e3o a anula\u00e7\u00e3o da mesma, conforme foi sugerido no release divulgado pelo ex-prefeito.
