Cinco meses depois do julgamento do Tribunal de Contas da Uni\u00e3o (TCU)<\/a><\/strong>, o presidente Luiz In\u00e1cio Lula da Silva (PT) ainda n\u00e3o devolveu o rel\u00f3gio Cartier avaliado em R$ 60 mil, recebido durante seu primeiro mandato, em 2005, em uma visita oficial \u00e0 Fran\u00e7a. No julgamento de agosto passado, o TCU isentou Lula da obriga\u00e7\u00e3o de devolver o presente franc\u00eas, mas estabeleceu um precedente jur\u00eddico que favoreceu o ex-presidente Jair Bolsonaro (PL) no caso das joias sauditas, o que enfureceu aliados do petista.<\/p>\n\n\n\n

A decis\u00e3o do tribunal definiu que, sem uma lei espec\u00edfica aprovada pelo Congresso, qualquer ex-presidente pode ficar com os presentes recebidos, independentemente do valor. Esse entendimento desfez uma norma do pr\u00f3prio TCU, de 2016, utilizada pela Pol\u00edcia Federal (PF) para justificar o indiciamento de Bolsonaro no caso das joias.<\/p>\n\n\n\n

Depois da decis\u00e3o, Lula teria demonstrado, em conversas com aliados, insatisfa\u00e7\u00e3o com o novo entendimento e sinalizou estar disposto a devolver o rel\u00f3gio. <\/p>\n\n\n\n

Procurada pelo jornal O Globo<\/em>, a Secretaria de Comunica\u00e7\u00e3o Social da Presid\u00eancia informou que, por orienta\u00e7\u00e3o da Advocacia-Geral da Uni\u00e3o (AGU), aguarda o julgamento de um recurso relacionado ao caso para tomar medidas sobre a devolu\u00e7\u00e3o. A AGU n\u00e3o comentou.<\/p>\n\n\n\n

No TCU, a expectativa \u00e9 de que o caso seja retomado entre fevereiro e mar\u00e7o deste ano, mas uma revers\u00e3o da decis\u00e3o \u00e9 considerada improv\u00e1vel. <\/p>\n\n\n\n

Ministros do tribunal avaliam que Lula demorou para agir e foi mal assessorado. Um dos ministros ouvidos afirmou, sob anonimato, que uma devolu\u00e7\u00e3o agora exigiria que Lula formalizasse uma doa\u00e7\u00e3o \u00e0 Uni\u00e3o, j\u00e1 que o TCU j\u00e1 reconheceu o rel\u00f3gio como propriedade dele.<\/p>\n\n\n\n

Lula recebeu o rel\u00f3gio da Cartier em 2005, em Paris, durante o Ano do Brasil na Fran\u00e7a. A pe\u00e7a, feita de ouro branco e prata, foi avaliada em R$ 60 mil.<\/p>\n\n\n\n

Recursos contra a decis\u00e3o sobre o rel\u00f3gio<\/h2>\n\n\n\n

Em setembro, a AGU apresentou recurso contra o novo entendimento do TCU, sob argumento de que o tribunal deveria manter a regra de 2016. <\/p>\n\n\n\n

A AGU e o Minist\u00e9rio P\u00fablico, junto ao TCU, defendem que a decis\u00e3o viola princ\u00edpios da administra\u00e7\u00e3o p\u00fablica e o interesse em preservar bens da Uni\u00e3o.<\/p>\n\n\n\n
