A ag\u00eancia de checagem acusou o site de integrar uma suposta \u201crede articulada de desinforma\u00e7\u00e3o\u201d em parceria com a vi\u00fava do coronel Carlos Alberto Brilhante Ustra.<br><br><br><br>Segundo a Aos Fatos, o site <em>Verdade Sufocada<\/em> (mantido pela esposa de Ustra) utilizaria um c\u00f3digo do servi\u00e7o Google Ad-Sense usado pelo <em>Jornal Cidade On-line <\/em>para monetiza\u00e7\u00e3o, o que comprovaria o v\u00ednculo com a \u201crede de <em>fake news\u201d<\/em>.<br><br><br><br><br>O advogado do <em>Jornal Cidade On-line<\/em>, Emerson Grigollette, solicitou ao Google que a acusa\u00e7\u00e3o fosse averiguada. A <em>big tech <\/em>informou em relat\u00f3rio: \u201cN\u00e3o encontramos nenhum registro de que a URL \u2018http:\/\/averdadesufocada.com\u2019 fa\u00e7a ou tenha feito parte do Programa do Google AdSense.\u201d<br><br><br><br><br>Ao proferir a senten\u00e7a, o juiz Diego Diel Barth, do Tribunal de Justi\u00e7a do Rio Grande do Sul, argumentou que o posicionamento do Google sobre o caso \u201cfez cair por terra\u201d a acusa\u00e7\u00e3o da Aos Fatos. O magistrado decidiu ainda que a ag\u00eancia de checagem tem de tirar do ar as mat\u00e9rias acusando o jornal.<br><br><br><br>\u201cPortanto, comprovada a conduta do agente, o dano e o nexo entre um e outro (publica\u00e7\u00e3o de not\u00edcia falsa), nos termos do artigo 186 do C\u00f3digo Civil, a consequ\u00eancia \u00e9 a responsabiliza\u00e7\u00e3o civil, conforme o artigo 927 do mesmo diploma legal\u201d, sustentou o magistrado, na decis\u00e3o publicada na sexta-feira 13.<br><br><br><br><br><strong>Ag\u00eancia de checagem Aos Fatos \u00e9 condenada a indenizar Oeste<\/strong><br>O juiz Marcelo Augusto Oliveira, da 41\u00aa Vara C\u00edvel do Tribunal de Justi\u00e7a de S\u00e3o Paulo (TJ-SP), condenou a ag\u00eancia de checagem Aos Fatos a pagar uma indeniza\u00e7\u00e3o no valor de R$ 50 mil \u00e0 Revista <strong>Oeste<\/strong> por danos morais depois de ter classificado duas reportagens como <em>fake news<\/em>.<br>Uma das reportagens censuradas pela Aos Fatos tratava do desmatamento na Amaz\u00f4nia, em julho de 2020, e informava que o n\u00famero de focos de inc\u00eandio na regi\u00e3o era menor que na Argentina naquele momento. <strong>Oeste<\/strong> usou imagens da Nasa para fazer a compara\u00e7\u00e3o.<br><br><br><br><br>A outra mat\u00e9ria, de mar\u00e7o de 2021, mostrou que a cidade mineira de S\u00e3o Louren\u00e7o n\u00e3o tinha nenhum paciente internado na UTI ou registro de morte por covid-19 naquele momento.<br>Fonte: Revista
