e eficaz, sendo que a sua repercuss\u00e3o jur\u00eddica na punibilidade est\u00e1 condicionada \u00e0 necess\u00e1ria decis\u00e3o judicial que declara extinta a pena do condenado<\/em>\u201d, disse Lind\u00f4ra.<br><ins class=\"adsbygoogle adsbygoogle-ablated-ad-slot\">\u201c<em>O decreto presidencial \u00e9 existente, v\u00e1lido e eficaz, sendo que o gozo dos benef\u00edcios da gra\u00e7a concedida est\u00e1 na pend\u00eancia da devida decis\u00e3o judicial que declare extinta a pena<\/em>\u201d, diz a manifesta\u00e7\u00e3o.<br>Sobre a multa aplicada por Alexandre de Moraes sob alega\u00e7\u00e3o de descumprimento pelo parlamentar de medidas cautelares, como a utiliza\u00e7\u00e3o de tornozeleira eletr\u00f4nica , a PGR defendeu que elas sejam revogadas a partir da data de expedi\u00e7\u00e3o do indulto presidencial, concedido em 21 de abril.<br>\u201c<em>Ocorre que, as medidas cautelares n\u00e3o podem perdurar indefinidamente, encontrando limite m\u00e1ximo de dura\u00e7\u00e3o no tr\u00e2nsito em julgado da decis\u00e3o condenat\u00f3ria<\/em>\u201d, disse Lind\u00f4ra.<br><ins class=\"adsbygoogle adsbygoogle-noablate\"><br>\u201c<em>Al\u00e9m de serem instrumentais, as medidas cautelares penais s\u00e3o acess\u00f3rias, provis\u00f3rias e homog\u00eaneas, ou seja, n\u00e3o podem ser aut\u00f4nomas, mais gravosas que a pr\u00f3pria san\u00e7\u00e3o
