Assim, a 1\u00aa Turma Recursal dos Juizados Especiais do Distrito Federal negou indeniza\u00e7\u00e3o \u00e0 deputada federal Joice Hasselmann (PSDB-SP) por falas do senador Styvenson Valentim (Podemos-RN) que insinuavam que a congressista tra\u00eda o marido e usava coca\u00edna.<br \/><img decoding=\"async\" src=\"https:\/\/www.conjur.com.br\/img\/b\/deputada-federal-joice-hasselmann.jpeg\" alt=\"\" width=\"300\" \/>Joice Hasselmann acordou em apartamento ferida e sem ideia do que havia acontecido<sup>C\u00e2mara dos Deputados<\/sup><br \/>Em julho do \u00faltimo ano, Joice acordou em seu apartamento com v\u00e1rios ferimentos, ensaguentada e sem saber o que tinha acontecido. O fato foi amplamente divulgado na imprensa.<br \/>Por meio de uma <em>live<\/em> em suas redes sociais, Styvenson deu a entender que o epis\u00f3dio seria fruto de trai\u00e7\u00e3o ao marido ou uso de drogas. &#8220;Aquilo ali, das duas uma: ou duas de 500&#8221;, disse ele, fazendo gestos de chifres com as m\u00e3os; &#8220;ou uma carreira muito grande&#8221;, completou, inspirando, como se cheirasse coca\u00edna.<br \/>A deputada acionou a Justi\u00e7a pedindo indeniza\u00e7\u00e3o por dano moral. O 3\u00ba Juizado Especial C\u00edvel de Bras\u00edlia considerou que as declara\u00e7\u00f5es do senador n\u00e3o foram motivadas pelo desempenho do mandato ou em raz\u00e3o dele, mas denotariam &#8220;mera opini\u00e3o pessoal&#8221;. Por isso, determinou o pagamento de R$ 3 mil \u00e0 autora.<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">TURMA RECURSAL<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ao reformar a senten\u00e7a, o&nbsp;juiz relator,&nbsp;Aiston Henrique de Sousa, lembrou que, conforme a Constitui\u00e7\u00e3o,&nbsp;os congressistas t\u00eam imunidade quanto a suas opini\u00f5es, palavras e votos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para responsabilizar os parlamentares por condutas praticadas fora da casa legislativa, a jurisprud\u00eancia do Supremo Tribunal Federal exige conex\u00e3o entre a ofensa e o desempenho das atribui\u00e7\u00e3o do cargo.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.conjur.com.br\/img\/b\/senador-styvenson-valentim-podemos.jpeg\" alt=\"\"\/><figcaption>Styvenson Valentim alegou que epis\u00f3dio seria fruto de trai\u00e7\u00e3o ou uso de drogas<sup>Roque de S\u00e1\/Ag\u00eancia Senado<\/sup><\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">O magistrado reconheceu que a fala de Styvenson ingressou em quest\u00f5es da vida pessoal de Joice. No entanto, ressaltou que o epis\u00f3dio envolve &#8220;uma parlamentar, no exerc\u00edcio do mandato, e em ambiente de tens\u00e3o pol\u00edtica&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com&nbsp;Aiston, &#8220;n\u00e3o se tem not\u00edcia de que tais fatos tenham sido resguardados no \u00e2mbito da vida privada&#8221;. Pelo contr\u00e1rio: o incidente foi alvo de inqu\u00e9rito policial e forte divulga\u00e7\u00e3o nos&nbsp;\u00f3rg\u00e3os de comunica\u00e7\u00e3o social.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Neste quadro, o debate sobre o que teria ocorrido no \u00e2mbito da resid\u00eancia da parlamentar se transforma em uma quest\u00e3o de ordem p\u00fablica de interesse do Parlamento, referente \u00e0 seguran\u00e7a dos ocupantes de cargos pol\u00edticos e da estabilidade das institui\u00e7\u00f5es&#8221;, destacou o juiz.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Assim, n\u00e3o seria poss\u00edvel exigir que o senador se omitisse em se manifestar sobre o tema, &#8220;at\u00e9 mesmo para dizer se a quest\u00e3o diz respeito \u00e0&nbsp;ordem privada ou p\u00fablica&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para o relator, &#8220;dizer que a discuss\u00e3o do tema n\u00e3o pode transbordar para a leviandade com acusa\u00e7\u00f5es de conte\u00fado difamat\u00f3rio, ou que houve excesso ou abuso, \u00e9 ingressar em ju\u00edzo de decoro e de adequa\u00e7\u00e3o no exerc\u00edcio da fun\u00e7\u00e3o parlamentar, que est\u00e1 vedado ao Poder Judici\u00e1rio&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O senador foi representado pelo escrit\u00f3rio<strong> Belarmino Sociedade de Advogados<\/strong>. A sustenta\u00e7\u00e3o oral ficou a cargo do advogado <strong>Antonio Belarmino Junior<\/strong>, presidente da Associa\u00e7\u00e3o Brasileira dos Advogados Criminalistas no Estado de S\u00e3o Paulo
